Divorce

Divorce is a legal process used to end a marriage and determine the division of property acquired during the marriage, child custody, child support, alimony, division of debt and attorney fees and other costs.

A divorce begins with a complaint or petition being filed in the superior court where, in most circumstances, the defendant lives. Once a complaint is filed the other party has 30 days to file a response, and both parties are free to participate in the discovery process according to state law.

Discovery is the legal procedure whereby each spouse obtains information about the other: each spouse is entitled to information about the other including bank account records, tax returns, other tax documents, retirement accounts, email records, and almost any other record or document created about you and your spouse during your marriage. Lawyers can use interrogatories (written questions answered under oath), depositions (the process whereby an attorney asks questions of the other party in front of a court reporter) and requests for production of documents among other discovery devices.

At Fox Legal we will guide you through each step of the process and answer each and every question you have along the way.

Divorce can be difficult, even in the most amicable of break-ups, but it does not have to be devastating. Often ex-spouses must continue to work with each other on parenting and finances, especially when there are children involved. Fox Legal will work with you to provide honest representation of your interests so that you and your spouse can move forward with separate lives without ruining the loving relationships between you, your children and the rest of your family.
